These Terms of Service ("Terms") govern your access to and use of the GreekFunder website and platform (the "Services"). In these Terms, "GreekFunder," "we," "us," and "our" refer to GreekFunder, a sole proprietorship, the operator of greekfunder.com, and its successors and assigns. "You" means the person accessing the Services, whether as an account holder or as a guest making a payment.
Please read these Terms carefully. They include important provisions that affect your legal rights, including a limitation of our liability, a class-action waiver, a jury-trial waiver, and your consent to receive records electronically. If you are making a payment as a guest without an account, the section titled Donor Terms is written to be read on its own and summarizes the terms that apply to your payment.
1. Acceptance of These Terms
By creating an account, accepting an invitation to join a Chapter, completing a payment, uploading content, or otherwise using the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by this reference. If you do not agree, do not use the Services.
When you register for an account or accept an invitation, we ask you to affirmatively indicate your agreement to these Terms and the Privacy Policy. When you complete a payment as a guest, you agree to these Terms (including the Donor Terms) at the point of payment. We keep a record of your agreement, including which version you agreed to and when.
If you accept these Terms on behalf of a Chapter or other organization, you represent that you are authorized to bind that organization, and "you" also refers to that organization. Chapters and their administrators are also subject to the separate Chapter Agreement, which governs the relationship between GreekFunder and each Chapter.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Services, to hold an account, or to make a payment. The Services are not directed to children, and we do not knowingly permit anyone under 18 to use them. By using the Services, you represent and warrant that you are 18 or older. If we learn that an account holder is under 18, we may suspend or terminate the account.
3. Who We Are and What GreekFunder Does
GreekFunder provides a technology platform that lets Greek-letter organizations ("Chapters," also referred to as Organizations) create fundraisers and attach events such as ticketed events, merchandise shops, photo contests, donation drives, and interactive giving boards. Chapters run their own fundraisers and set their own goals, descriptions, items, prices, and events. A "User" is anyone with a GreekFunder account. A "Donor" is anyone who makes a payment, whether through an account or as a guest. A "Payment" is any charge made through the Services, including a donation, a ticket purchase, a merchandise purchase, or a giving-board square. A "donation" is the gift portion of a Payment.
We are not a party to the relationship between a Donor and a Chapter. GreekFunder is not a charity, a fundraiser, a broker, an agent, a trustee, or a fiduciary for any Chapter, User, or Donor. We do not solicit contributions on any Chapter's behalf, we do not control how a Chapter uses the funds it raises, and we do not guarantee any Chapter, any fundraiser, any event, or any use of funds. Each Chapter is solely responsible for its own fundraisers, content, events, communications, and use of the money it raises.
Merchant of record and custody of funds. For card-network and commercial purposes, GreekFunder acts as the merchant of record for Payments made through the Services. Payments are processed by our payment processor, Stripe, through Stripe's regulated payment rails, and funds settle directly into the Chapter's own connected Stripe account. GreekFunder never takes custody of Donor funds. We are not a bank, a money transmitter, or a payment processor, and we do not hold, pool, or escrow the money you pay. The Chapter is the seller and beneficiary of each Payment; you are paying the Chapter, and GreekFunder facilitates that Payment as the platform and merchant of record.
4. Accounts
To use certain features, you must create an account with accurate information and keep it current. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly at [email protected] if you suspect unauthorized use. You may not share your account, use another person's account without permission, or create an account using false information or on behalf of someone else without authority.
A single User may belong to more than one Chapter. Chapter membership and administrative roles are created by invitation from an existing Chapter administrator; they are not available by self-signup. Your permissions within a Chapter depend on the role that Chapter assigns you. We may refuse, suspend, or terminate any account at our discretion, as described in the Termination section below.
5. Chapters, Fundraisers, and Fulfillment
Chapters use the Services to raise funds for their own organizational purposes. When you make a Payment, you are transacting with the Chapter, not with GreekFunder.
Fulfillment is entirely the Chapter's responsibility. The Chapter, not GreekFunder, is responsible for everything it offers or promises, including event admission and entry, the quality and description of merchandise and items, honoring tickets, and delivering anything a Donor pays for. Merchandise and items are made available for in-person pickup only — GreekFunder does not ship, deliver, store, or handle any physical item, and we are not responsible for pickup, no-shows, event cancellations, changes, quality, or any dispute about what you received. If an event is cancelled, changed, or postponed, or if you do not receive what you paid for, you must look to the Chapter. GreekFunder does not guarantee that any event will occur, that any goal will be met, or that any item will be provided.
If a Chapter cancels a ticketed event, the Chapter is responsible for refunding purchasers. Purchasers should contact the Chapter, and GreekFunder support may be able to help facilitate a refund as described in the Fees & Refund Policy.
6. Payments, Fees, and Refunds
Payments are processed by Stripe and settle into the Chapter's connected Stripe account, as described above. GreekFunder charges a platform fee on each Payment, and Stripe charges its own processing fee. At checkout you may choose whether to cover these fees so that the Chapter receives the full amount of your gift; that choice is itemized in dollars before you pay and is yours to make.
The complete and controlling terms for fees, the minimum Payment amount, the option to cover fees, refunds and the refund window, chargebacks, payout timing, and event-cancellation handling are set out in the Fees & Refund Policy, which is incorporated into these Terms by this reference and forms part of your agreement with us. Please read it before you pay. In summary, and subject to that policy: a Donor may request a refund within a limited window after payment; refunds are issued in full; the Chapter — not GreekFunder — bears the platform fee and the processing fee on refunds and bears the full cost of chargebacks; and there is a minimum Payment amount. If there is any conflict between this summary and the Fees & Refund Policy, the Fees & Refund Policy controls. We do not restate the fee calculations here so that the Fees & Refund Policy remains the single source of truth.
7. Donor Terms
This section is written so that a Donor, including a guest paying without an account, can read it on its own. It summarizes the terms that apply when you make a Payment. The rest of these Terms and the Privacy Policy also apply to you.
Who you are paying. When you make a Payment through the Services, you are paying the Chapter that created the fundraiser, not GreekFunder. The Chapter is the seller and the recipient of the funds and is solely responsible for the fundraiser, any event, any item, admission, pickup, and the use of the funds. GreekFunder provides the platform and, for card-network purposes, acts as the merchant of record; your Payment is processed by Stripe and settles into the Chapter's own Stripe account, and GreekFunder never takes custody of your funds.
Your choice to cover fees. A platform fee and a payment-processing fee apply to your Payment. At checkout you may choose whether to cover those fees. The amount is shown to you in dollars before you pay and is entirely optional; if you cover the fees, the Chapter receives the full amount of your gift, and if you decline, the Chapter absorbs the fees.
Refunds. Refunds are governed by the Fees & Refund Policy. You may request a refund within the window described there; refunds are issued in full. For questions about an event, an item, admission, a cancellation, or anything you paid for, contact the Chapter first; GreekFunder support may be able to help as described in that policy.
Tax deductibility. Unless a receipt from the Chapter expressly states otherwise, your Payment is not tax-deductible as a charitable contribution. Many Chapters are social organizations to which payments are not deductible. GreekFunder makes no representation about the tax treatment of any Payment or the tax status of any Chapter. Any receipt is issued by the Chapter, in the Chapter's name, and you should consult your own tax advisor.
Age. By making a Payment, you represent that you are at least 18 years old.
Electronic delivery. By making a Payment, you consent to receive your receipt and any related records electronically, at the email address you provide or through the Services. See the Electronic Communications section for details and how to withdraw consent.
Agreement. If you are a guest, you are bound by these Terms (including these Donor Terms) and by the Privacy Policy when you complete a Payment. We keep a record of your agreement, including the version and the time.
8. Your Content and License to Us
The Services let Users and Chapters submit content, including fundraiser and event descriptions, cover images, team images, merchandise photos, photo-contest submissions, captions, and attendee names ("Content"). You retain ownership of the Content you submit, and you are solely responsible for it.
You grant GreekFunder a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and adapt your Content — including resizing, cropping, and processing it — for the purpose of operating, providing, securing, and promoting the fundraiser and the Services. This license lets us show your Content on the pages where it belongs and prepare the image variants the Services need. The license ends when your Content is removed from the Services, except that we may retain copies as required by law, for backup and recordkeeping, or as described in our Privacy Policy.
By submitting Content, you represent and warrant that: you own the Content or have all rights necessary to submit it and grant the license above; every identifiable person shown in the Content has consented to its posting; and the Content complies with these Terms and our Acceptable Use Policy. You must not submit Content you are not authorized to share or that includes an identifiable person who has not consented.
9. Acceptable Use and Copyright
Your use of the Services and all Content you submit must comply with our Acceptable Use Policy and our Copyright / DMCA Policy, each of which is incorporated into these Terms by this reference. Among other things, the Acceptable Use Policy prohibits content involving the sexual exploitation of minors, sexually explicit content and nudity, harassment, bullying, doxxing, threats, hate, illegal activity, infringement, impersonation, spam, malware, hazing or dangerous-initiation content, and content depicting underage drinking or drug use, as well as photos of identifiable people who have not consented.
We respond to notices of alleged copyright infringement and terminate the accounts of repeat infringers in appropriate circumstances, as described in the Copyright / DMCA Policy. Copyright notices should be sent to our designated agent at [email protected]. Violations of these Terms or the Acceptable Use Policy may result in removal of Content, strikes against your account, suspension, or termination.
10. Moderation and No Safety Promises
The Services host Content submitted by Users and Chapters, and that Content is their responsibility, not ours. We may, but are not obligated to, review, monitor, screen, remove, refuse, or restrict any Content or account at our sole discretion, for any reason or no reason, with or without notice. We use automated content-safety tools to help identify certain prohibited images, including an on-device screening model and, for images it flags, a review by a cloud content-safety service; these tools help us operate the Services and are not a guarantee. Our content-safety tools are not facial recognition and do not identify individuals.
We do not verify Chapters, Users, fundraisers, or Content, and we make no promise that any Chapter is legitimate, that any fundraiser is genuine, that funds will be used as described, that any Content is accurate, or that the Services are safe. Any moderation we choose to perform is discretionary and does not create a duty to you or a warranty of any kind. You are responsible for your own decisions about whether to support a Chapter or fundraiser.
11. Taxes and Receipts
GreekFunder makes no representation about the deductibility of any Payment or the tax or charitable status of any Chapter, and does not offer pass-through donations to outside charities. Chapters use the Services to raise funds for their own organizational purposes. Any receipt is issued by the Chapter, in the Chapter's name, and the Chapter is responsible for the accuracy of its receipts and for its own income taxes. Unless a Chapter's receipt expressly states otherwise, a Payment is not tax-deductible as a charitable contribution. You should consult your own tax advisor about the treatment of any Payment.
Chapters are responsible for their own sales and use taxes in the interim. GreekFunder reserves the right to calculate, collect, and remit sales or similar taxes where applicable law requires the platform to do so. Where required by federal law, GreekFunder may file information returns reporting a Chapter's Payments; the Chapter remains the taxpayer on its own income.
12. Giving Boards
Some fundraisers use interactive giving boards that display preset gift amounts on squares. Claiming a square is a gift to the Chapter. It is not a wager. There is no prize, no drawing, no winner, and no element of chance. A giving board is a way to visualize giving, not a raffle, lottery, bingo game, or game of chance. Chapters must not attach any prize, reward, or element of chance to a giving board, and doing so violates these Terms and the Chapter Agreement.
13. Electronic Communications
By using the Services, you consent to receive communications from us electronically, including receipts, tax and payment documents, disclosures, and legal notices, delivered by email or through the Services. You agree that electronic communications satisfy any legal requirement that a communication be in writing. To access and retain these communications, you need a device with internet access, a current web browser, and an email account. You may request a paper copy of any record, or withdraw your consent to electronic delivery, by emailing [email protected]; withdrawing consent may limit or prevent your use of the Services. Keep your contact information current so we can reach you.
14. Disclaimer of Warranties
THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, GREEKFUNDER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WITHOUT LIMITING THE FOREGOING, GREEKFUNDER MAKES NO WARRANTY THAT ANY CHAPTER IS LEGITIMATE OR HAS ANY PARTICULAR TAX OR CHARITABLE STATUS, THAT ANY PAYMENT IS TAX-DEDUCTIBLE, THAT FUNDS WILL BE USED AS DESCRIBED, THAT ANY FUNDRAISER WILL REACH ITS GOAL, THAT ANY EVENT WILL OCCUR, OR THAT ANY TICKET, ITEM, ADMISSION, OR OTHER BENEFIT WILL BE PROVIDED. GREEKFUNDER DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT IS ACCURATE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.
15. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, GREEKFUNDER AND ITS OWNERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF GREEKFUNDER ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE TOTAL FEES YOU PAID TO GREEKFUNDER IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
THE EXCLUSIONS AND LIMITATIONS IN THIS SECTION DO NOT APPLY TO LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR FRAUD; TO LIABILITY FOR DEATH OR PERSONAL INJURY; OR TO ANY OTHER LIABILITY THAT APPLICABLE LAW DOES NOT PERMIT TO BE LIMITED OR EXCLUDED. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU. THESE LIMITATIONS ARE A FUNDAMENTAL BASIS OF OUR AGREEMENT AND APPLY EVEN IF A LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
16. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless GreekFunder and its owners, employees, agents, and service providers from and against any claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: your use of the Services; your Content; your fundraisers, events, items, or fulfillment; your Payments; your violation of these Terms, the Acceptable Use Policy, the Copyright / DMCA Policy, the Fees & Refund Policy, or any applicable law; your violation of any right of another person or entity, including any right of privacy, publicity, or intellectual property; and, for Chapters, any failure to provide accurate receipts, to satisfy tax or charitable-solicitation obligations, or to fulfill what was offered. We may assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with us.
17. Termination and Wind-Down
We may suspend or terminate your access to the Services, or any account, at our discretion, with or without notice, including if we believe you have violated these Terms or applicable law, or to protect the Services, other users, or GreekFunder. You may stop using the Services at any time, and account holders may request account deletion.
Termination does not end obligations that by their nature should survive, and the following continue to apply after termination or account deletion: any pending payouts and open Payments; any open refunds or chargebacks and the resolution of disputes; the Chapter's authorization for us to reverse transfers to, and debit, its Stripe account balance for amounts it is responsible for; our retention of records, including Payment records retained in redacted form as described in our Privacy Policy; and the sections of these Terms concerning Content licenses already granted, disclaimers, limitation of liability, indemnification, taxes, governing law, and dispute resolution. We may deactivate or remove Content and access to the Services after termination, subject to our retention obligations.
18. Changes to These Terms
We may update these Terms from time to time. The effective date appears at the top of this page. For non-material changes, the updated Terms take effect when posted with an updated effective date. For material changes, we will provide notice by email or through the Services, and — where required — we will ask you to agree to the updated Terms again before you continue to make Payments or otherwise transact through the Services. Continued passive browsing of the Services does not by itself constitute acceptance of a material change. If you do not agree to an updated version, you must stop using the Services. We keep prior versions and can identify the version you agreed to.
19. Governing Law, Venue, and Dispute Resolution
These Terms and any dispute arising out of or relating to these Terms or the Services are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You and GreekFunder agree that the exclusive venue for any dispute that is not otherwise resolved will be the state and federal courts located in California, and you and GreekFunder each consent to the personal jurisdiction of those courts.
Class-action waiver. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND GREEKFUNDER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
Jury-trial waiver. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND GREEKFUNDER EACH WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES.
Small claims. Nothing in this section prevents either you or GreekFunder from bringing an individual claim in a small-claims court that has jurisdiction, if the claim qualifies.
20. General
20.1 Assignment
You may not assign or transfer these Terms, or any rights or obligations under them, without our prior written consent, and any attempted assignment in violation of this section is void. We may assign or transfer these Terms, in whole or in part, to a successor or affiliate or in connection with a merger, acquisition, reorganization, or sale of assets. These Terms bind and benefit the parties and their permitted successors and assigns.
20.2 Severability
If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
20.3 Entire Agreement
These Terms, together with the Privacy Policy, the Acceptable Use Policy, the Copyright / DMCA Policy, and the Fees & Refund Policy — each incorporated by reference — and, for Chapters, the Chapter Agreement, are the entire agreement between you and GreekFunder regarding the Services, and they supersede any prior agreements on that subject. Our failure to enforce any provision is not a waiver of it.

We may provide notices to you by email, by posting on the Services, or through your account. You may send notices to us at [email protected]. You consent to receive notices electronically, as described in the Electronic Communications section.
